Terms of Service

Effective Date: 01.01.2023.

These Terms of Service (“Terms”) govern all photography services provided by Nikola Georgijević Photography (“Photographer”, “we”, “us”, or “our”) to any individual, company, or entity (“Client”, “you”, or “Contractor”). By booking or engaging our services, you agree to the following terms and conditions.

1. Scope of Services

The Photographer agrees to provide professional photography services as described in the agreed quotation, proposal, or contract. Specific deliverables, timelines, and fees are detailed in the project agreement or invoice.

2. Copyright and Usage Rights

All photographs taken by Nikola Georgijević are and remain the exclusive intellectual property and copyright of the Photographer.

·       The Photographer retains full ownership, copyright, and usage rights across all domains, including but not limited to digital, print, social media, promotional, and editorial usage.

·       The Client is granted a limited, non-exclusive, non-transferable license to use the delivered photographs solely for personal or agreed-upon commercial purposes, as outlined in the service agreement.

·       Any reproduction, sale, or modification of the photographs without prior written consent from the Photographer constitutes a violation of copyright law.

·       The Photographer reserves the right to use the images for portfolio, website, social media, competitions, exhibitions, or promotional materials, unless the Client has explicitly requested otherwise in writing before the session.

3. Client Responsibilities

The Client agrees to cooperate fully and to provide necessary information and access required for the successful performance of the services. Any delay or failure to provide such cooperation may result in rescheduling or additional fees.

4. Equipment Protection and Liability

The Client or event organizer is responsible for any intentional or negligent damage to the Photographer’s equipment during the course of the event or photo session.

·       In cases where damage occurs due to recklessness, intentional interference, or failure to follow Photographer’s instructions, the Client shall be liable for the full cost of repair or replacement of the affected gear.

·       The Photographer is not liable for interruptions or delays in service caused by unsafe working conditions, unauthorized interference, or environmental hazards.

5. Use of Lasers and Hazardous Equipment

The Client or event organizer must inform the Photographer in advance of any use of lasers, pyrotechnics, fog machines, or similar stage or visual equipment that could pose a risk to photographic gear or personal safety.

·       The Photographer reserves the right to refuse shooting or to relocate equipment if such devices are used without proper notice or without protective measures in place.

·       Any damage resulting from unreported or unsafe use of such equipment will be the sole responsibility of the Client.

6. Payment and Cancellation

Full payment terms, deposits, and cancellation policies are outlined in each project’s agreement. A booking is confirmed only after receipt of the required deposit. Deposits are generally non-refundable unless otherwise stated.

7. Limitation of Liability

While the Photographer takes all reasonable care during the performance of services, liability is limited to the total value of the contract. The Photographer shall not be liable for consequential losses, missed shots, or technical failures beyond reasonable control.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Belgrade, Serbia.

9. Acceptance

By booking, confirming, or proceeding with photography services, the Client acknowledges that they have read, understood, and agreed to these Terms of Service in full.
